We are honest with our customers and provide the following information up front prior to your rental, rather than having it appear as a shock later should such an event occur.

BELLA’S RENTALS rents to the person signing this agreement (further known herein as “Renter”) for an electric mobility scooter and included accessories (further known herein as “Equipment”) and is subject to all the terms and conditions set forth in this Rental Agreement. The Renter agrees: Equipment is the sole property of BELLA’S RENTALS and is in good working condition when received. Renter will return the Equipment in the same condition as when received at the end of the rental period for inspection and battery recharge (if necessary), or sooner, upon demand by BELLA’S RENTALS

Personal Property

BELLA’S RENTALS shall not be liable or responsible for the loss of or damage to any property left, lost, damaged, stolen, stored or transported by Renter, its agents, servants, or employees, or any other person using the Equipment, either before or after the return thereof. Renter assumes all risk of such loss or damage and waives all claims against BELLA’S RENTALS by reason thereof. Renter agrees to hold BELLA’S RENTALS harmless from and to defend and indemnify BELLA’S RENTALS against all claims based upon or arising out of such loss or damage.

Renter assumes all risk and liability for any loss, damage or injury, including death, to persons or property of Renter or others arising out of the use of the Equipment.

Equipment Condition

Renter affirms that BELLA’S RENTALS provides the Equipment in good operating condition and that the Equipment is clean and free of damage. Renter is responsible for the Equipment and any included accessories and will reimburse BELLA’S RENTALS for the full cost of replacement upon demand for any damage, loss, theft, or destruction of the Equipment and any included accessories. Renter understands and authorizes that BELLA’S RENTALS will

document any repair or replacement costs of the Equipment and any included accessories. BELLA’S RENTALS will arrange for the repair or replacement.

Requirements to Rent an Equipment

Renter must be able produce when requested by BELLA’S RENTALS a valid ID before the rental takes place. The ID must have been issued by authorized authorities. When the rental booking is made from outside the USA Renter must also be able to produce, when requested, a valid identity card or a valid passport issued by the country of your residence. Renter must be aged 21 or over to rent our mobility equipment. You must produce a valid credit card with an expiry date after the rental end date. No scooters or equipment can be rented against cash or check payment unless such payment exceeds the retail value of the scooter or equipment to be rented.

Operation of Equipment

Renter shall require drivers to operate the Equipment with reasonable care and diligence and comply with any polices and ordinances in the locations where it is used along with the terms of this agreement. The following restrictions are cumulative and each shall apply to every use, operation or driving of the Equipment; under no circumstances shall the Equipment be used or operated by any other person under 18 years of age. No 2nd riders of any kind. No phone calls or texting while in operation. Renter also agrees to not use the equipment under any of the following conditions or for any of the following purposes: a) operating the scooter or equipment

under the influence of alcohol, drugs or any other type of narcotic substances; b)carrying anything which, because of its smell or condition, harms the Vehicle or causes BELLA’S RENTALS to lose time or money before it can rent the scooter/equipment again; c) transportation of animals (with the exception of assistance animals); c) re-rental to or use by other persons; d) carrying passengers; e) pushing or towing another vehicle; f) traveling on a surface of which could put the equipment, tires or its under body mechanics at risk; g) intentionally committing any offence; h) none of the goods and baggage carried in or on the equipment, including their packing and stowage equipment, will be permitted to damage the equipment, nor put the occupants abnormally at risk; i) in any way which breaks the highway Code, road traffic laws or any other laws.

Renter shall defend, indemnify and hold harmless BELLA’S RENTALS, all of their agents, officers, servants, and employees from and against any and all losses, liability claims, damages, injuries, demands, actions and causes of action whatsoever, arising out of or related to any loss, damage or injury claimed by persons that may arise from the use, operation or driving of the Equipment, provided that such loss or damage was not caused by the fault or gross negligence and willful misconduct of BELLA’S RENTALS or its employees. Renter assumes all costs and expenses of every kind and nature, including legal fees and disbursements arising out of and in connection with the use, operation or driving of the Equipment. BELLA’S RENTALS assumes no liability or responsibility for any acts or omissions of Renter or of Renter’s agents, servants, or employees.

Damage, Loss, Theft and Reporting

Renter shall notify BELLA’S RENTALS within two hours of any and all accidents and damage resulting from the use, operation or driving of the Equipment. Renter agrees to pay all costs, expenses, and attorneys fees incurred by BELLA’S RENTALS in collecting sums due or in regaining possession of Equipment or in enforcing or recovering any damage, losses or claims against Renter. The Renter agrees to inform BELLA’S RENTALS immediately of any defect or malfunction while in use. Once notified, BELLA’S RENTALS will make every effort to remedy the issue in a timely manner. Renter is responsible for the loss, theft, damage or destruction of the Equipment and agrees to pay the full replacement value for the rental item(s). The Renter also agrees to authorize the replacement cost of the rental item(s) to the Renter’s credit card given at time of rental or delivery. The Renter agrees to return the rental item(s) and all accessories in the same condition as it was delivered, and to report any loss, theft, damage or destruction to the rental item(s) immediately to BELLA’S RENTALS.

Representation

Renter or driver of the Equipment shall in no event be deemed the agent or employee of BELLA’S RENTALS in any manner or for any purpose whatsoever. Any individual executing this Agreement as Renter in a representative capacity shall be bound personally, jointly and severally, with such fiduciary, corporation or other entity as to all obligations, expressed or implied, arising hereunder. If any provisions hereof or the application of any provisions to any

person or circumstance is held invalid or unenforceable, the remainder hereof and the application of such provision to other persons or circumstances shall remain valid and enforceable.

Rates

The total charges for each rental will be determined according to the price list applicable at the time of rental and full rental price will be charged at the time of booking.

Payment Policies

BELLA’S RENTALS accepts major credit cards (MasterCard, Visa, Discover Card, and American Express) for credit identification and payment at the time of rental. BELLA’S RENTALS upon delivery may require an Identification like a valid Passport, valid Driver’s License or a valid State issued (Non driver’s) Identification Card with picture to verify who we are delivering the item to. Debit Cards can be used only as a form of payment of rental charges.

Note: Prepaid Debit/Gift cards are not acceptable methods of credit or identification. Checks/Money Orders are not accepted.

Cancellation or No Show Policy

The Renter can cancel a booking at any time up to 24 hours before your rental is due to start and receive a refund minus a $25 administration charge to cover our administration expenses incurred. These include credit card fees that we pay when we charge your card and again when we make a refund. Bookings canceled within 24 hours of the rental start date BELLA’S RENTALS will refund minus one days rental fee. Rentals canceled after your equipment is delivered or is out for delivery will not be refunded in any part whatsoever. All refunds will be refunded only to the EXACT credit card the original charge was processed on. In the case of a closed account or canceled debit , credit card, or gift card a future rental credit voucher will be issued.

Rental Period

Renter undertakes to return the equipment to BELLA’S RENTALS at the agreed place, on the date and at the time indicated in the rental agreement. The rental duration is calculated on the basis of indivisible periods of 24 hours, starting from the time the scooter/equipment is made available. However, a 30-minute grace period is applied at the end of the rental before the start of a new 24-Hour rental period begins. If you return the equipment to any other location other than the agreed location, repatriation costs will be charged to you. This includes abandonment for any reason at any location without prior authorization from BELLA’S RENTALS. You agree that

these costs will be charged to your credit/debit card lodged with BELLA’S RENTALS requiring no additional authorization, with a minimum fee of $25.

Rental Extensions and Equipment Return

Equipment and any included accessories are due back at the date/time specified on the rental agreement so the Equipment can be picked up. If you need to extend your rental, you must call prior to expiration date and time to determine if the rental can be extended. BELLA’S RENTALS may, at its own discretion allow or deny any extension. BELLA’S RENTALS reserves the right to charge the Renter’s card and Renter agrees to allow the charge of $25 for each additional day or fraction of a day the Equipment is kept by the Renter beyond the prearranged return date and time on the rental contract. A $25 fee will be applied for return trips to pick up rental items if not returned at the agreed upon time as listed in the rental reservation or prior agreed upon written arrangement for return. Renter may request a change of product for reasons of size or transportation issues; the approval of the request is at the sole discretion of BELLA’S RENTALS and will be based on the availability of equipment and delivery personnel. A $25 fee applies to any exchanges. The Renter is responsible to pay the replacement cost of any lost parts or accessories, whether paid for or provided free of charge. Dead Battery, Key Loss or Re-Delivery

The Equipment is fully charged at time of delivery; Renter is responsible to charge the battery as needed. We recommend keeping the Equipment plugged in overnight whether the power meter shows a discharge or not. The unit is designed to charge automatically, however do not keep the Equipment charger plugged in more than twenty four (24) hours, as damage to the battery can occur. If you forget to charge the battery and become stranded, you may call us and request a delivery of a fully charged battery, at a fee of $50 during business hours (9AM – 5PM, Monday – Friday) and $75 all other times. If Renter loses the key during rental a $10 fee for key replacement fee is charged.

Data Protection Law

Please note that in the course of the performance of the booking as well as the rental process, BELLA’S RENTALS collects some personal data. It is mandatory to provide all the information requested; in the absence of such information BELLA’S RENTALS will not be able to correctly ensure the booking and/or the rental.

Lifting and/or loading scooters/equipment

Caution is advised when lifting or loading any of our equipment to include but not restricted to loading in and out of vehicles. This includes items such as batteries and scooter parts which are also heavy. Anyone attempting to lift any of our equipment should at all times adopt correct

lifting practices to prevent injury, loss or damage. BELLA’S RENTALS cannot accept or take responsibility for injury, loss or damage caused by the incorrect lifting or loading of any of our equipment. We advise that at all times you have someone to assist you when lifting or loading our equipment and you do not attempt any lifting or loading if you are unsure you are fully able to do so.

Printed manual is available upon request at time of rental. It provides safety and operational instructions to safely use / operate the Equipment.
